These Terms of Service ("Terms") govern your use of the website seamlessgutterslayers.com and our holiday lighting site, holiday.seamlessgutterslayers.com (together, the "Website"), operated by Eli Buss, doing business as Seamless Gutter Slayers ("Eli," "we," or "us"). By accessing or using this Website, you agree to be bound by these Terms. How we handle your information is explained in our Privacy Policy.

1. Services Description

Seamless Gutter Slayers provides seamless gutter installation, gutter repair, fascia and soffit work, leaf guard installation, downspout and drainage solutions, and annual maintenance services, and accent and holiday lighting, for residential and commercial properties in the Knoxville and East Tennessee area. This Website provides information about these services and allows visitors to request estimates and quotes and download business documents.

2. Estimates and Pricing

• All estimates provided through this Website, by phone, or in person are non-binding and provided for informational purposes only until a written agreement is executed by both parties.
• Final pricing may vary from estimates based on actual site conditions discovered during inspection. Eli will communicate any material changes before proceeding with work.
• Estimates are valid for 30 days from the date of issuance unless otherwise stated.
• Sending an estimate or quote request does not book a job. Holiday lighting work is done under the written quote, design and service agreement you approve; this Website gives only a summary of that agreement.
• We provide honest, transparent pricing with no hidden fees. The scope of work, materials, and pricing will be clearly documented before any work begins.

3. 2 Year Workmanship Warranty

• What it covers: for 2 years from the day the job is finished, Seamless Gutter Slayers warrants its workmanship on gutters it installs: leaks at seams, end caps, corners, outlets and fasteners caused by our work; gutters not pitched correctly to drain; and sections or hangers that pull loose because of how they were installed.
• Clogs are covered only on runs where we installed a gutter guard (leaf guard) system. Without a guard installed by us, clogs and cleaning are not covered.
• Materials: Eli inspects every piece of gutter, coil and hardware when he installs it, and anything with a flaw doesn't go on your house. The materials also carry the manufacturer's own warranty, which passes to you; Eli helps you use it if you ever need to.
• What it does not cover: drain tile and underground drain lines, including their clogs; storm, hail, falling trees or limbs or other acts of nature; ice dams and heavy snow loads; damage from ladders, impacts, roof work or other trades after our install; settling or rot of fascia or framing we did not replace; pests; changes or repairs made by someone else; routine cleaning; normal wear and fading.
• If you sell your home, the warranty stays with the house for the rest of the 2 years.
• To make a claim, contact Eli (section 17 below) with your address and a photo.

4. Your Right to Cancel Home Sales

If you sign an agreement with us at your home, you generally may cancel it until midnight of the third business day after you sign. This right comes from the Federal Trade Commission's Cooling-Off Rule and Tennessee's home solicitation sales law (Tenn. Code Ann. § 47-18-701 et seq.). When it applies, your agreement includes a "Buyer's Right to Cancel" notice and a Notice of Cancellation form, and Eli will tell you about it when you sign.

5. Payments

Online card payment is not available yet. Our Make a Payment page shows how to reach us, and we arrange payment with you directly against your written estimate, agreement or invoice. We never ask for card numbers by email or text.

6. Messages and WhatsApp

By sending us a request with your phone number or email, you agree that we may contact you about that request, including by text. Message and data rates may apply. Reply STOP to stop texts. WhatsApp is a service of Meta; messages you send there are also subject to WhatsApp's terms.

7. Service Area

We serve Knoxville, Maryville, Alcoa, Farragut, Oak Ridge, Powell, Clinton, Sevierville, Pigeon Forge, Gatlinburg, Lenoir City, Tellico Village, and surrounding East Tennessee communities in Knox, Blount, Loudon, Sevier, Anderson, Roane, and Jefferson counties. Service availability in specific locations may vary. Contact Eli to confirm service availability in your area.

8. Website Use

• The content on this Website — including text, images, videos, and educational articles — is provided for general informational purposes only.
• You may not reproduce, distribute, or republish content from this Website without prior written consent.
• You agree not to use this Website for any unlawful purpose or to submit false information through our forms.
• Educational content (Gutter Education Center) is provided for general knowledge and should not be considered professional advice for your specific situation.

9. Document Downloads

Certain documents available on this Website (such as insurance certificates) require you to provide contact information before downloading. By submitting your information, you consent to Eli contacting you to verify the request and follow up as appropriate. Documents are provided for legitimate business purposes only and may not be altered, redistributed, or used for fraudulent purposes.

10. Limitation of Liability

To the fullest extent permitted by Tennessee law, Seamless Gutter Slayers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this Website. Our total liability for any claim arising from use of this Website shall not exceed the amount you have paid to us for services, if any. This limitation does not apply to claims that cannot be limited by law. It covers your use of this Website only: it does not limit our responsibility for our own work, for damage we cause through our negligence or misconduct, or the warranty for your job.

11. Indemnification

You agree to indemnify and hold harmless Eli Buss, doing business as Seamless Gutter Slayers, from any claims, damages, or expenses arising from your misuse of this Website or violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Knox County, Tennessee. Before initiating legal action, both parties agree to attempt good-faith negotiation to resolve the dispute.

13. Tennessee Consumer Protection

These Terms are subject to the Tennessee Consumer Protection Act (Tenn. Code Ann. § 47-18-101 et seq.). Nothing in these Terms limits your rights under Tennessee consumer protection laws, including the right to cancel a home solicitation sale described above and the right to file a complaint with the Tennessee Division of Consumer Affairs.

14. Business Information

Seamless Gutter Slayers is owned and run by Eli Buss in Knoxville, Tennessee. Eli has completed OSHA 10-Hour Construction safety training and has more than 20 years of experience installing seamless gutters. Seamless Gutter Slayers carries general liability insurance; a certificate of insurance is available on request.

Some jobs need a permit or a license depending on where you live and the size of the job. Before you sign, Eli will tell you whether your job needs either and who will get it.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Website after modifications constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
